Dear Elmont Parents,
I write to give you an update on the status of Governor Hochul’s mask mandate for New York public schools. As I believe you are aware, a Nassau County State Supreme Court judge issued a Decision and Order on Monday, January 24, 2022, declaring New York State Regulation 10NYCRR 2.60, the mask mandate, null, void, and unenforceable.
Shortly after the decision was issued, the New York State Education Department issued a directive to public schools stating that the State would obtain a Stay of the Court’s order pending an appeal. To avoid unnecessary temporary actions and confusion, and on advice of counsel, this district elected to continue the mask requirement.
The Office of the New York Attorney General submitted an Order to Show Cause appealing Judge Rademacher’s decision to the Appellate Division Second Department in Brooklyn. Argument was held at 2:00 PM today, January 25, 2022.
The Appellate Division has granted the requested Stay, the mask mandate remains, and we will continue using the protocols now in place.
